The Portfolio of Legal Affairs, in keeping with its statutory obligations, provides access to documents that it holds. Access is provided within the framework of the Freedom of Information Law, 2007.

The Freedom of Information (FOI) Law was passed on 19th October 2007 and comes into effect in January 2009. It gives the public a right of access to all types of records held by public authorities, but also sets out some exemptions from that right.

The FOI Law 2007 gives a number of rights to any person including the right:

  • To access a record other than an exempt record or an exempt portion of a record
  • To request that a record which contains a person’s personal information be amended or annotated if it is incomplete, incorrect, out of date or misleading and if it has been used, is being used or is available for use by a public authority for administrative purposes
  • To apply for a review of a decision that refuses access, gives partial access or defers access, or a decision to charge a fee, or a decision regarding the amount of the fee

Publication Schemes

Each public authority covered by the Freedom of Information Law has a legal duty to adopt and maintain a publication scheme in accordance with s. 5 of the FOI Law. The main purpose of a publication scheme is to make information readily available without the need for specific written requests. Schemes are intended to encourage organisations to publish proactively, and develop a greater culture of openness.
